This Privacy Policy sets forth how APPNEX, OPC (“AppNex,” “we,” “our,” or “us”) collects, uses, processes, retains, discloses, and protects personal data and other information, as well as the rights and choices available to data subjects in relation thereto in accordance with the Data Privacy Act of 2012.

1. Scope of this Privacy Policy

This Privacy Policy applies to all AppNex products and services, including mobile and desktop applications (collectively, the “Services”), the website AppNex.ph, and other websites owned and operated by AppNex (collectively, the “Websites”), and any other engagements with AppNex (such as customer service inquiries, user conferences, communications, and the like).

By accessing or using the Services, Websites, or engaging with AppNex, the user hereby agrees to be bound by this Privacy Policy. Any form of dissent shall prohibit the use and/or engagement of any form with Appnex.

This Privacy Policy does not apply to:

● Any third-party applications or software that integrate with the Services through the AppNex platform (“Third-Party Services”); or

● Any other third-party products, services, or business offerings.

A separate written agreement shall govern the delivery, access, and use of the Services (the “Contract”), including the processing of any data (“Service Data”) submitted through the platform. The entity or organization that entered into the Contract with AppNex (the “Customer”) controls its instance of the Services and the Service Data within (the “Customer Instance”).

2. Collection and Receipt of Information by Appnex

AppNex may collect, generate, and receive Service Data and Other Information (together, the “Information”) in the following manner:

● Service Data: Submitted by Customers and Authorized Users within a Customer Instance when using the Services.

● Account Information: Including but not limited to email addresses, phone numbers, domain information, and other required credentials; Billing details such as credit card data, banking information, and billing addresses may also be collected for paid Services.

● Services Metadata: Metadata generated through interactions with the Services, e.g., integrations with Third-Party Services, and the like.

● Log Data: Information automatically collected by servers when Websites or Services are accessed, such as IP address, referring URL, browser type, date and time, and cookie data.

● Device Information: Device type, operating system, identifiers, settings, and crash data.

● Location Information: Derived from IP addresses, business addresses, device settings, and/or information submitted by Customers and Authorized Users.

● Cookies and Similar Technologies: Used to collect Other Information subject to AppNex’s Cookie Policy.

● Third-Party Services: When enabled by a Customer, AppNex may receive limited Information from Third-Party Services (e.g., usernames, email addresses) for integration purposes.

● Contact Information: Submitted through the creation of an account or engagement with AppNex.

● Third-Party Data Sources: Information obtained from affiliates, partners, and other entities to enhance and further develop AppNex’s business operations.

● Additional Information: Submitted through communications, participation in events, contests, or interactions with AppNex’s social media.

● Google API Data: Processed in strict compliance with the Google API Services User Data Policy, including Limited Use provisions.

3. How AppNex Uses Information

AppNex acts as a processor of Service Data, while the Customer is the controller.

In furtherance of AppNex’s legitimate business interests, the platform also processes Other Information/s including:

● Providing, maintaining, updating, and protecting Services and Websites;

● Communicating with Customers and Authorized Users;

● Developing and improving Services, including aggregated and anonymized data;

● Sending administrative, service-related, technical, and security communications;

● Sending marketing and promotional messages (subject to user preferences); and

● Managing billing, account, and administrative requirements.

4. Data Retention

● Service Data: Retention in accordance with the Contract, customer settings, and other legal requirements (such as but not limited to the Non-Disclosure Agreement, apart from that set in the Contract);

● Other Information: Retained as may be necessary for purposes set out in this Privacy Policy, including legal compliance, dispute resolution, and enforcement of agreements;

● Customer data and credentials: Retained up to 365 days following termination unless earlier deletion is requested.

● Applicant data: Retained up to three (3) years unless earlier deletion is requested.

● Website visitor data: Retained in accordance with the Cookie Policy.

5. Sharing and Disclosure of Information

AppNex may share Information in the following circumstances:

● Displaying Services: Information displayed to Authorized Users within the Customer Instance.

● Service Providers and Partners: For processing and business support, subject to confidentiality obligations.

● Third-Party Services: Enabled at Customer’s discretion, with information shared as required for integration.

● Corporate Affiliates: Shared with parent company, subsidiaries, or affiliates.

● Business Transactions: In the event of mergers, acquisitions, reorganizations, or similar corporate activities.

● Legal Compliance: If compelled by law, subject to reasonable notice to Customer unless legally prohibited.

● Fraud Prevention and Safety: To protect AppNex, Customers, Authorized Users, and third parties.

● With Consent: Where explicit consent is provided by the data subject or Customer.

6. Security

AppNex employs industry-standard technical and organizational safeguards to ensure the confidentiality, integrity, and availability of Information. While AppNex strives to protect Information, no method of transmission or storage is entirely secure. Users are advised that third-party websites accessed through AppNex are not under the latter’s control.

7. Age Limitations

AppNex does not knowingly allow individuals under the age of 18 to use the Services or Websites as prohibited by law. Any knowledge obtained by Appnex that a minor has provided personal information, the same shall be promptly deleted.

8. Changes to this Privacy Policy

Any updates to the Privacy Policy are subject to the changes in law, regulations, or business practices, if any, and shall be communicated through appropriate channels (e.g., email or in-Service notifications). Continued use of the Services constitutes acceptance of any revisions or amendments to the policy.

AppNex shall only transfer personal data across jurisdictions in accordance with Applicable Data Protection Laws in case of changes in service provider.

● Appropriate safeguards, including contractual transfer agreements, shall be implemented where required.

● Exceptions to transfer restrictions may only be applied after approval by AppNex’s designated Legal and Privacy Representatives and, where applicable, the Global Data Privacy Team.
